Terms & conditions
The agreement between [Company legal name] and businesses that use Tablyvio.
Effective 20 October 2026 · Last updated 20 October 2026
1. About these terms
These terms and conditions ("Terms") form an agreement between [Company legal name] ("we", "us") and the business that signs up for Tablyvio ("you", "the Customer"). By creating an account, starting a trial or using the service, you accept these Terms on behalf of your business and confirm you are authorised to do so.
2. Definitions
- Service: the Tablyvio point-of-sale software, in the browser or installed on a device, together with related websites, updates, onboarding and support.
- Plan: the subscription you choose, such as Starter, Professional or Enterprise, with the limits shown on our pricing page or in your order.
- Customer Data: the menus, orders, invoices, guest and staff records and other data you or your staff put into the Service.
- Users: your staff and others you allow to use the Service.
3. Your account
You must give us accurate business and contact details and keep them up to date. You are responsible for everything done under your account, for the Users you create, and for keeping PINs, devices and backups secure. Tell us straight away if you believe your account has been misused.
4. Your right to use the Service
While your subscription is active and paid, we grant you a non-exclusive, non-transferable right for your Users to use the Service for your own restaurant operations in line with your Plan. You may not resell, sublicense, copy, modify, reverse-engineer or create competing products from the Service, or use it for anyone else's business without our written agreement.
5. Free trial
We may offer a free trial, usually for 7 days. Trials are provided as they are, without service commitments, and may be ended or changed at any time. At the end of the trial you may choose a paid Plan; if you don't, access is paused. Customer Data from a trial may be deleted 30 days after the trial ends.
6. Plans, fees and VAT
Fees are shown in US dollars. VAT or other taxes are added where the law requires it. Monthly Plans are billed in advance each month and yearly Plans are billed in advance for the year. We may change our prices by giving you at least 30 days' notice; changes apply from your next billing period. Device and outlet limits apply as stated in your Plan.
7. Payment
You agree to pay invoices by the due date using the payment methods we offer. If a payment is late, we may remind you and, after 14 days, suspend the Service until payment is received. We are not liable for any loss caused by a suspension for non-payment.
8. Your responsibilities
- Tax and legal compliance. The Service helps you produce VAT tax invoices and reports, but you remain responsible for your prices, tax settings, TRN, VAT returns, licences and compliance with UAE law, including any e-invoicing obligations that apply to you. Check your set-up with your accountant.
- Accuracy of data. You are responsible for the accuracy and legality of Customer Data, including having a lawful basis and any required consent for guest and staff data you record.
- Backups. Where Customer Data is stored on your devices, you must make regular backups using the backup feature. We cannot recover data lost from a device that was not backed up.
- Equipment and connectivity. You provide and maintain suitable devices, printers, internet access and supported browsers.
9. Acceptable use
You must not use the Service to break the law, record false transactions or invoices, evade tax, send spam, infringe others' rights, introduce malicious code, or try to access accounts or systems you are not authorised to use. We may suspend access to stop serious misuse.
10. Customer Data and privacy
You own your Customer Data. You give us permission to host, process and back up Customer Data only to provide and support the Service and as required by law. We process personal data in Customer Data as your processor in line with our privacy policy and UAE data protection law, and we will help you respond to requests from individuals. We will not sell Customer Data or use it to market to your guests.
11. Availability, updates and changes
We aim to keep the online Service available at all times except during planned maintenance, which we try to schedule outside busy trading hours and announce in advance where practical. The installed app keeps working without internet as described on our website. We update the Service regularly and may add, change or remove features, but we will not materially reduce the core features of your Plan during a paid period without notice.
12. Support
We provide onboarding and support through the channels and during the hours listed on our support page. Response times listed there are targets, not guarantees, unless agreed in a separate written service level agreement.
13. Third-party services and hardware
Some features connect to services provided by others, such as payment terminals, delivery platforms, messaging services and e-invoicing service providers. Your use of them is also governed by their terms, and we are not responsible for their availability or acts. Hardware is supplied by its manufacturer or reseller under their warranty.
14. Intellectual property
We and our licensors own all rights in the Service, the Tablyvio name and logo, and our website. These Terms do not transfer any of those rights to you. If you send us suggestions, we may use them freely without obligation to you.
15. Confidentiality
Each party will keep the other's confidential information secret and use it only for the purposes of these Terms, except where disclosure is required by law.
16. Warranties and disclaimers
We will provide the Service with reasonable skill and care. Apart from that, and to the extent the law allows, the Service is provided "as is" and we do not promise that it will be uninterrupted or error-free, or that it will meet every requirement of your business.
17. Limitation of liability
To the extent permitted by UAE law: (a) neither party is liable for indirect or consequential loss, or for loss of profit, revenue, goodwill or data that could have been prevented by backups; and (b) our total liability arising out of or in connection with these Terms in any 12-month period is limited to the fees you paid us for the Service in that period. Nothing in these Terms limits liability that cannot be limited by law.
18. Indemnity
You will compensate us for losses arising from claims by third parties caused by your breach of these Terms, unlawful use of the Service, or Customer Data you provide.
19. Term, cancellation and termination
Your subscription continues for successive monthly or yearly periods until cancelled. You may cancel as set out in our cancellation and refund policy. Either party may end the agreement with immediate effect by written notice if the other materially breaches these Terms and does not fix the breach within 14 days of being asked. We may also end the Service with 60 days' notice.
20. After your subscription ends
For 30 days after your subscription ends, you can export your Customer Data on request. After that we may delete it from our systems, except where we must keep records by law. Data stored on your own devices remains under your control.
21. Changes to these Terms
We may update these Terms. We will give at least 30 days' notice of significant changes by email or in the Service. If you do not agree, you may cancel before the change takes effect.
22. Governing law and disputes
These Terms are governed by the laws of the United Arab Emirates as applied in the Emirate of Dubai. The parties will first try to settle any dispute in good faith. If that fails within 30 days, the courts of Dubai have exclusive jurisdiction.
23. General
Neither party is liable for delays caused by events beyond its reasonable control. You may not transfer this agreement without our consent. If any part of these Terms is found unenforceable, the rest remains in force. These Terms, together with your order and any signed agreement, are the entire agreement between us. If these Terms are translated, the English version prevails.
